Adequate Representation in Child Custody and Visitation Disputes
When parents of minor children divorce, the well-being of their children must take priority. California courts, like those of other states, make custody rulings based on what they consider to be in the child’s best interests. But no judge understands your family as well as you do, which is why you need a determined advocate to protect your rights and those of your children. In divorces involving children, we deliver thorough arguments in matters such as:
- Physical custody — This type of custody refers to where the child will reside and is based on a range of factors including safety, education and even the child’s preference in some cases.
- Legal custody — Divorcing parents must set forth how major decisions affecting their children’s lives — such as education, childcare, healthcare and religious upbringing — will be handled. Often, this authority is shared.
- Visitation —Non-custodial parents deserve to spend meaningful time with their children so that they can maintain a healthy relationship going forward. I help negotiate and execute visitation agreements that protect that relationship and your rights.
Joint legal and physical custody is authorized when both parents agree to it. Even when disputes over other matters cannot be worked out, I make an extra effort to resolve parenting conflicts through consensus for the well-being of everyone involved.
Ensuring your child’s needs are met
Child support depends on a variety of factors, such as, the custodial timeshare, health insurance payments, tax exemption status, as well as other factors. We will work to ensure you have an accurate and adequate child support order in place so that your children’s needs are met despite any marital issues you are experiencing. Conversely, if you are paying support, we will ensure that the order is properly calculated to accurately represent the circumstances factored into the amount of support.
We will work to secure a spousal support order
California calculates spousal support in two phases. The first is meant to preserve “the status quo” pending a final adjudication of your case, which is commonly referred to as guideline or pendente lite spousal support. This amount is calculated by a computer program based on various data, such as each party’s income, income tax filing status and other factors. At the end of your case, the second phase of spousal support will be determined by the marital standard of living which also includes several factors, and is typically lower than that of temporary support. Divorce does not have to end in financial disaster. Whether you will be receiving support or paying it, Hanna & Saucedo, LLP will work to ensure you have a proper support order in place so that you can create a new life for yourself.
Working for the equitable distribution of assets and debts
California is a community property state which means that all property acquired during the marriage is presumptively community property and will be divided equally upon divorce, unless otherwise agreed. If there is a question about whether a particular asset is part of the marital estate or separate property, we will advise you on how the law applies to your case. You can be assured that no asset will be overlooked and if you have more complex assets, such as business interests, retirement or investment accounts, an expert will be retained to ensure each party receives his/ her representative interest. At Hanna & Saucedo, LLP, we work with you to create an equitable and favorable property and debt division. We will utilize our skills to present you with creative property settlements to best suit your needs.
Assisting clients with post-judgment issues
As circumstances change, it is sometimes necessary to revisit certain issues after you have obtained a final divorce judgment. Hanna & Saucedo, LLP can assist you efficiently and effectively through this process so that you can move forward with your life. Spousal support, sometimes referred to as alimony, is determined by numerous factors, including the length of the marriage, each partner’s age, and their respective earning ability. By working closely with each client, we bring the court’s attention to important issues that might not be apparent, such as the loss in potential income due to years spent at home taking care of the household. The duration of spousal support is often tied to how long the marriage lasted, but where special circumstances exist, such as poor health, we argue for a fair resolution.
